Disclosure of Information
Hairology Extensions may share non-Personal Information, such as aggregated user statistics and your Device Identifiers with third parties along with data related to you and your activities. Also, we may share your information, including your Personal Information, with third parties, such as companies with which we have marketing or other relationships, for the third parties’ direct marketing purposes. If you are a California resident, you have the right to request additional information and so please see the Section entitled “Your California Privacy Rights” below about these rights. In addition, Hairology Extensions may share the information we have collected about you, including Personal Information, as disclosed at the time you provide your information and as described in this Privacy Policy. Examples of when Hairology Extensions may share your information include as follows:
(a) Third Parties Providing Services to Company. Hairology Extensions may use third-party service providers to perform certain services on behalf of us or the Site, such as: (i) to assist us in Site operations; (ii) to manage a database of customer information; (iii) hosting the Site; (iv) designing and or operating the Site’s features; (v) tracking the Site’s activities and analytics; (vi) enabling us to send you special offers or perform other administrative services; and (vii) other services designed to assist us in maximizing our business potential. Hairology Extensions may provide these vendors with access to user information to carry out the services they are performing for you or for us.
(b) To Protect the Rights of Company and Others. To the fullest extent permitted by applicable law, Hairolgy Extensions may also disclose your information if we believe in good faith that doing so is necessary or appropriate to: (i) protect or defend the rights, safety or property of Company or third parties (including through the enforcement of this Privacy Policy, our Terms & Conditions, and other applicable agreements and policies); or (ii) comply with legal and regulatory obligations (e.g., pursuant to law enforcement inquiries, subpoenas or court orders). To the fullest extent permitted by applicable law, Hairology Extensions has complete discretion in electing to make or not make such disclosures, and to contest or not contest requests for such disclosures, all without notice to you.
(c) Affiliates and Business Transfer. Hairology Extensions may share your information with our parent, subsidiaries and affiliates, which currently includes, but is not limited to, Moor Capital. As part of this sharing of information with our parent, subsidiaries and affiliates, this means that once you provide us with information, any one of our related brands may use your information including for marketing purposes, pursuant to the terms of this Privacy Policy. We also reserve the right to disclose and transfer all such information: (i) to a subsequent owner, co-owner or operator of the Site and or our Stores; or (ii) in connection with a merger, consolidation, restructuring, the sale of substantially all of our interests and or assets or other corporate change, including during the course of any due diligence process.
(d) Sweepstakes, Contests and Promotions. Hairology Extensions may offer sweepstakes, contests, and other promotions (any, a “Promotion”) through the Site, in the Stores or through one of our social media pages that may require registration. If you choose to enter a Promotion, Personal Information may be disclosed to third parties or the public in connection with the administration of such Promotion, including in connection with winner selection, prize fulfillment, and as required by law or permitted by the Promotion’s official rules, such as on a winner’s list.
SUBMISSIONS
With the exception of your personal information, any communication or material you send to Hairology Extensions, electronically or otherwise, including but not limited to data, questions, comments, suggestions, or submissions is and will be treated as non-confidential and non- proprietary. Anything you send to Hairology Extensions, it may be used by Hairology Extensions, for any purpose including but not limited to modification, reproduction, transmission, disclosure, publication, broadcast, and posting. By submitting material to Hairology Extensions, you irrevocably transfer and assign to Hairology Extensions. You are agreeing not to assert, copyrights, “moral” rights, rights of publicity or to privacy, or other intellectual-property or proprietary rights that you may have in such material. Hairology Extensions is free to use, without obligation of any kind, any ideas, concepts, techniques, or know-how contained in any communication you send to Hairology Extensions site for any purpose whatsoever, including but not limited to developing, manufacturing, and marketing products and services.
COPYRIGHTS, AND OTHER RIGHTS
Hairology Extensions, does not accept liability beyond the remedies set forth herein, including any liability for products not being available for, or the provision of services and support. Hairology Extensions, will not be liable for consequential, special, indirect or punitive damages even if advised of the possibility of such damages, or for any claim by any third party except as expressly provided herein. This limitation of liability applies both to products and services. Customer agrees that for any liability related to the purchase of products, Hairology Extensions, is not liable or responsible for any amount of damages above the aggregate dollar amount paid by customer for the purchase of products under this agreement. Customer agrees that for any liability related to the purchase of services not bundled with products under this agreement, Hairology Extensions, is not liable or responsible for any amount of damages above the aggregate dollar amount paid by customer for the purchase of services under this agreement.
Images of people or places displayed on the Hairology Extensions site are either the property of, or used with permission by, Hairology Extensions, use of these images by you or other third
parties is prohibited unless expressly permitted in the Terms of Use or elsewhere on the Hairology Extensions site. Any unauthorized use of these images may violate copyright laws, trademark laws, the laws of privacy and publicity, and other applicable regulations and statutes. Any product, service, program or technology described in any document published by Hairology Extensions, on this site may be the subject of other intellectual property rights owned by Hairology Extensions and reserves any such right that is not expressed licensed hereunder.
